WEST PALM BEACH, FL, & LONDON, UNITED KINGDOM, April 2, 2020 / — The Mexican Ministries of Health issued a final rule (NOM-051) on March 27, 2020 that mandates a new front package labeling (FOPL) system for all packaged foods, to warn consumers against products that exceed strict thresholds for sodium, caloric content, added sugars and saturated fats.

Under the new rule, salty snack brands will need to prominently add the warning “Excess Sodium” (Exceso Sodio) if the product exceeds 350mg of sodium per 100g of product. Snack brands will need to add the label depicted above if their current product exceeds the recommended limit. The implementation date for the FOPL warnings is October 1st, 2020, with more stringent nutrient thresholds starting October 1st, 2023.

Mexican snack manufacturers are now being challenged to reduce sodium levels without impacting the taste of their products. In the snack industry, where flavor is everything, manufacturers are faced with the potential of new warning labels decreasing their sales if they don’t reduce sodium, and if they do, it will also negatively impact sales due to a less savory product.

SPAIN, April 1, 2020 / — Letter of Credit accomplish their purpose by substituting the credit of the bank for that of the customer, for the purpose of facilitating trade. There are basically two types: commercial and standby. The commercial letter of credit is the primary payment mechanism for a transaction, whereas the standby letter of credit is a secondary payment mechanism.

Commercial Letter of Credit:
Commercial letters of credit have been used for centuries to facilitate payment in international trade. Their use will continue to increase as the global economy evolves.

Letter of credit used in international transactions are governed by the International Chamber of Commerce Uniform Customs and Practice for Documentary Credits. The general provisions and definitions of the International Chamber of Commerce are binding on all parties. Domestic collections in the United States are governed by the Uniform Commercial Code.

A commercial letter of credit is a contractual agreement between a bank, known as the issuing bank, on behalf of one of its customers, authorizing another bank, known as the advising or confirming bank, to make payment to the beneficiary. The issuing bank, on the request of its customer, opens the letter of credit. The issuing bank makes a commitment to honor drawings made under the credit. The beneficiary is normally the provider of goods and/or services. Essentially, the issuing bank replaces the bank's customer as the payor.

Elements of a Letter of Credit:

• A payment undertaking given by a bank (issuing bank)

• On behalf of a buyer (applicant)

• To pay a seller (beneficiary) for a given amount of money

• On presentation of specified documents representing the supply of goods

• Within specified time limits

• Documents must conform to terms and conditions set out in the letter of credit

• Documents to be presented at a specified place

The beneficiary is entitled to payment as long as he can provide the documentary evidence required by the letter of credit. The letter of credit is a distinct and separate transaction from the contract on which it is based. All parties deal in documents and not in goods. The issuing bank is not liable for performance of the underlying contract between the customer and beneficiary. The issuing bank's obligation to the buyer, is to examine all documents to insure that they meet all the terms and conditions of the credit. Upon requesting demand for payment the beneficiary warrants that all conditions of the agreement have been complied with. If the beneficiary (seller) conforms to the letter of credit, the seller must be paid by the bank.

Issuing Bank:
The issuing bank's liability to pay and to be reimbursed from its customer becomes absolute upon the completion of the terms and conditions of the letter of credit. Under the provisions of the Uniform Customs and Practice for Documentary Credits, the bank is given a reasonable amount of time after receipt of the documents to honor the draft.

The issuing banks' role is to provide a guarantee to the seller that if compliant documents are presented, the bank will pay the seller the amount due and to examine the documents, and only pay if these documents comply with the terms and conditions set out in the letter of credit.

Typically the documents requested will include a commercial invoice, a transport document such as a bill of lading or airway bill and an insurance document; but there are many others. Letters of credit deal in documents, not goods.

Advising Bank:
An advising bank, usually a foreign correspondent bank of the issuing bank will advise the beneficiary. Generally, the beneficiary would want to use a local bank to insure that the letter of credit is valid. In addition, the advising bank would be responsible for sending the documents to the issuing bank. The advising bank has no other obligation under the letter of credit. If the issuing bank does not pay the beneficiary, the advising bank is not obligated to pay.

Confirming Bank:
The correspondent bank may confirm the letter of credit for the beneficiary. At the request of the issuing bank, the correspondent obligates itself to insure payment under the letter of credit. The confirming bank would not confirm the credit until it evaluated the country and bank where the letter of credit originates. The confirming bank is usually the advising bank.

Botanical Adulterants Prevention Program Publishes Turmeric Laboratory Guidance Document

New publication evaluates methods to authenticate turmeric products and describes adulteration.

AUSTIN, TEXAS, USA, April 1, 2020 / — The ABC-AHP-NCNPR Botanical Adulterants Prevention Program (BAPP) announces the publication of a new Laboratory Guidance Document (LGD) on turmeric (Curcuma longa) raw material and products.

Turmeric has a long history of use as a spice and medicinal plant, but its popularity has only recently started to surge for its medicinal properties in countries outside Asia. In 2018, turmeric dietary supplements ranked second and third in sales in the US natural food store and mainstream retail outlet channels, respectively, according to the annual Herb Market Report for 2018 published in HerbalGram, the peer-reviewed journal of the American Botanical Council (ABC).

Reports of turmeric adulteration often describe substitution with other Curcuma species or the undeclared admixture of starches or dyes. More recently, the addition of undeclared synthetic curcumin, one of the naturally occurring substances in turmeric, and mixtures of synthetic curcuminoids to turmeric extracts, has been reported. Synthetic curcuminoids can be made for about one-third of the cost of natural curcuminoids, providing a financial incentive to fraudulent suppliers for diluting or replacing turmeric extracts with synthetic materials.

The new LGD is written by John H. Cardellina II, PhD, a noted expert in natural products chemistry and analysis. The LGD provides an evaluation of the usefulness of published analytical methods to detect the adulteration of turmeric root/rhizome raw material and extracts, and finished turmeric products, and summarizes the main advantages and disadvantages of each method regarding its suitability for use in a quality control laboratory. In addition, the document details the chemical composition of turmeric root and rhizome, potential confounding species, and known adulterants. The LGD has been peer-reviewed by 29 international experts from academia, third-party contract analytical laboratories, and the herbal dietary supplement and herb and spice industries. BAPP previously published a Botanical Adulterants Prevention Bulletin on turmeric in May 2018.

Stefan Gafner, PhD, chief science officer of ABC and technical director of BAPP, explained: “Because adulteration of turmeric comes in various shapes and forms, a number of orthogonal methods (i.e., multiple methods that can measure different analytes in a sample) are needed to ensure that the turmeric ingredient is authentic. Chromatographic methods may be useful for the detection of other Curcuma species or certain pigments, but they may miss the undeclared admixture of starches or the presence of lead chromate, which is sometimes added to impart a stronger yellow color. The possible addition of synthetic curcuminoids presents yet another analytical challenge. As such, we hope that the turmeric LGD will provide a useful guide for industry quality control analysts tasked to select the most appropriate assays for turmeric authentication.”

Mark Blumenthal, ABC founder and executive director, and BAPP founder and director, said: “Once again, BAPP has identified a common spice that has a growing public demand for its medicinal properties, and which unscrupulous sellers in the international herb market have adulterated with lower-cost adulterants and fraudulent materials. BAPP’s newest LGD on turmeric will be a much-needed beneficial resource for hundreds of industry, university, third-party, and government analytical laboratories around the world.”

Cardellina opined: “The adulteration of turmeric is one of the more complex cases that BAPP has tackled. Synthetic organic and inorganic colorants used to improve the color of poor grade or fraudulent raw material present serious health and safety concerns, while substituting or admixing with other species of Curcuma deprives consumers of the beneficial compounds provided by C. longa. The addition of synthetic curcuminoids can create safety issues due to the possible presence of reagents and side products from the synthetic methods used. Fortunately, this LGD reviews a substantial number of analytical methods to address these many forms of adulteration.”

The turmeric LGD is the 10th publication in the series of LGDs published by BAPP. As with all publications in the program (currently 57), LGDs are freely accessible to all ABC members, registered users of the ABC website, and all members of the public on the program’s website (registration required).

New capital investment in clean fuels will help drive Canada’s economic recovery and growth

Clean Fuel Standard is key to attracting over $12 billion in advanced biofuels projects

VANCOUVER, BRITISH COLUMBIA, CANADA, April 1, 2020 / — The challenges facing the global economy are unprecedented. Two forces – the COVID-19 pandemic and the recent breakdown in the global oil cartel – have brought acute pressures to Canada’s economy. Economic recovery measures that focus on accelerating clean energy transitions will make a lasting impact on Canada’s economic and energy future.

To inform clean fuel sector development, Advanced Biofuels Canada (ABFC) conducts an annual member survey to capture project-based data on capital investments in advanced biofuels and synthetic fuel production capacity and supporting infrastructure for the decade ahead (2020-2030). Results from 18-member companies surveyed in late 2019 indicate Canada can increase production capacity by at least 5 billion litres per year by 2030 (see Backgrounder).

Companies were re-surveyed in March 2020 to assess the impact of the COVID-19 crisis. While some operating plants have scaled back or closed (1 plant), project development plans remain active. Investment plans are being reevaluated to assess regulatory signals and financial feasibility. Survey data (partial) captured 11 projects, representing over $1.25 billion in capex, that remain in active development in AB (3), BC (3), ON (2), QC (2), and NS (1).

In November 2019, ABFC released the Roadmap to 2030 sector report on clean liquid fuel investment in Canada. The report highlights how western and central Canada (i.e. BC to Quebec) are reliant on imports of over 12 billion litres per year of finished fossil fuels, such as gasoline, diesel, and jet fuel, to fuel our economy. Solutions to resolve market access for Canada’s export of bitumen and natural gas will not address the insufficient refining capacity to supply fuels to Canada’s core manufacturing, farming, mining, and forestry regions. Co-processing biomass at refineries will reduce greenhouse gas emissions from refined fuels, but investment in new clean fuel production capacity is needed to address our long-term economic growth and transition to zero-emission fuels. Advanced biofuels production capacity supports Canada’s farmers, foresters, and resource communities, by creating long-term, sustainable jobs for skilled workers and value-added manufacturing that reduces commodity market export risks.

In January 2020, ABFC released its Canada’s Clean Fuel Strategy brief and presented the summary recommendations to the Standing Committee on Finance to outline key policy, regulatory and fiscal measures that would support widescale deployment of new investment in Canada’s clean fuel sectors (advanced biofuels/synthetic fuels, electric vehicles, renewable natural gas, and solid biomass). The brief identifies core policies to attract private sector investment in clean fuels production capacity and infrastructure, and to maintain leadership in clean technologies such as ‘waste to fuels’ innovation platforms. These recommendations are even more relevant today, as we seek to navigate a course to economic recovery following the COVID-19 pandemic and mitigate risks from the structural downturn and exposure to foreign oil policies.

“The federal Clean Fuel Standard is the cornerstone policy to attract billions of dollars in clean fuel investments, and help restart the Canadian economy,” stated Ian Thomson, ABFC President. “The jobs and benefits to rural and urban Canadians are well understood, as are the immediate reductions in greenhouse gases and air pollution. Calls to delay or repeal the CFS are misguided – the CFS is a key market- and performance-based tool to spur Canada’s economic recovery, attracting clean fuel investments in petroleum operations, agricultural and forestry biomass supply chains, waste management, renewable power generation, EV adoption, hydrogen and other renewable gases, and new biofuel production capacity. The global energy transformation plays to Canada’s strengths – we have clean renewable power, sustainable biomass resources, a skilled labour force, and nation-wide infrastructure primed to move supplies and goods to market. We call on the federal and provincial governments and political parties to frame a unified vision of Canada’s clean energy future – we need to do this now to eliminate policy risks and remove barriers to new, clean energy capital investments.
